These Terms of Service govern your access to and use of isafemboy.gay. They are a binding agreement between you and the operator of the Service. Please read them carefully, in particular the sections on disclaimers, limitation of liability and indemnification, which limit our responsibility to you.
1. Agreement to Terms
By accessing or using isafemboy.gay ("the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not access the Service.
The Service is an invite-only platform designed for creating custom bio pages with personalized subdomains. Access is granted exclusively to members who have received and redeemed a valid invitation code.
These Terms apply to every visitor, member and person who accesses the Service, including anyone who merely views a member page hosted on a subdomain. If you are entering into these Terms on behalf of an organisation, you represent that you have authority to bind that organisation.
No obligation to provide the Service. The Service is offered free of charge, on a voluntary basis, and as a community project. Nothing in these Terms obliges us to provide, continue, restore or maintain the Service, any feature of it, or your access to it.
2. Definitions
"Service" means the isafemboy.gay website, its dashboard, its APIs, all member subdomains, and any related functionality we make available.
"Member" means a person who has redeemed a valid invitation code and holds an active account.
"Your Content" means anything you create, upload, submit, link to, embed or display through the Service, including text, images, sounds, links, page configuration and your chosen subdomain.
"Member Page" means the publicly accessible page published at a subdomain of isafemboy.gay.
"Moderator" means any person authorised by us to review content and enforce these Terms.
3. Eligibility and Account Registration
To use the Service, you must:
- Be at least 13 years of age (or the minimum age required in your jurisdiction)
- Possess a valid Discord account and complete Discord OAuth verification
- Have received a valid invitation code from an existing member or administrator
- Provide accurate, current, and complete information during registration
- Maintain the security and confidentiality of your account credentials
If you are resident in the European Economic Area, you must be at least 16 years old, or have the consent of the holder of parental responsibility, where that is required by the data protection law of your country. We may refuse or terminate an account where we have reasonable grounds to believe the age requirement is not met.
You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach.
One person may hold one account unless we expressly permit otherwise. You may not sell, rent, lend or transfer your account, and you may not allow another person to use it. Accounts have no monetary value and are not property.
We may refuse registration, or suspend or delete any account, at our sole discretion and without being required to give a reason. Access to the Service is a revocable permission, not a right or an entitlement.
4. Acceptable Use Policy
You agree to use the Service in compliance with all applicable laws and these Terms. You agree NOT to:
- Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
- Engage in any form of harassment, bullying, stalking, or intimidation of other users
- Distribute spam, unsolicited messages, or engage in any form of commercial solicitation
- Upload malware, viruses, or any code designed to disrupt, damage, or limit the functionality of the Service
- Attempt to gain unauthorized access to other users' accounts, the Service's systems, or networks
- Resell, trade, or transfer invitation codes for monetary gain or other compensation
- Scrape, crawl, or use automated means to access the Service without express written permission
- Use the Service to host, display, or transmit content that infringes any copyright, trademark, patent, trade secret, or other intellectual property rights
- Engage in any activity that disrupts or interferes with the Service or servers and networks connected to the Service
Strictly prohibited content
The following will result in immediate and permanent termination without warning, and may be reported to the competent authorities:
- Any sexual content involving minors, or any content that sexualises a person under 18, whether real, drawn, generated or implied
- Content that depicts, promotes, incites or glorifies terrorism, extremism, genocide, or mass violence
- Credible threats of violence against any person or group, or content intended to provoke such violence
- Content promoting self-harm, suicide, or eating disorders as desirable or instructional
- Non-consensual intimate imagery, so-called revenge pornography, upskirt or hidden-camera material
- Doxxing: publishing another person's private information, including home address, phone number, workplace, identity documents or private communications, without their consent
- Human trafficking, sexual services for payment, or the sale of controlled substances, weapons, stolen data or stolen goods
- Malware distribution, phishing, credential harvesting, or any page designed to deceive visitors into disclosing information
- Material that infringes the rights of others where you have been notified and have not removed it
Adult content
Where the Service permits adult content, you must mark it correctly using the tools we provide, you must have the right to publish it, every depicted person must be an adult and must have consented to publication, and you must comply with the law of your jurisdiction. Mislabelling adult content is a serious violation of these Terms.
Technical restrictions
- Do not use the Service as a file host, a content delivery network, a proxy, a redirector for unrelated traffic, or a backup service
- Do not attempt to circumvent rate limits, access controls, authentication, moderation tooling or the invite system
- Do not probe, scan or test the vulnerability of the Service, or breach its security, except under a written agreement with us
- Do not place a load on the Service that is unreasonable or disproportionate compared to ordinary member use
- Do not reverse engineer, decompile or disassemble any part of the Service except to the extent that this restriction is prohibited by mandatory law
Reporting. If you encounter content that breaches this policy, report it to us through our Discord server or the contact address on our contact page. Reports should identify the page and describe the problem so we can act on it.
5. Content Ownership and License
You retain all ownership rights to the content you create, upload, or share through the Service ("Your Content"). By posting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display Your Content solely for the purpose of operating and providing the Service.
You represent and warrant that:
- You own or have the necessary rights and permissions to use and share Your Content
- Your Content does not violate any third-party rights, including intellectual property rights and privacy rights
- Your Content complies with these Terms and all applicable laws
The licence you grant is limited to what is technically necessary to host, cache, back up, transmit, resize, transcode and display Your Content, and to show it in the Service's own interfaces. It ends when you delete Your Content or your account, except for copies retained in backups until they are overwritten in the ordinary cycle, and copies we must keep to comply with a legal obligation or to defend a legal claim.
We do not claim ownership of Your Content and we will not sell it, licence it to advertisers, or use it to train machine learning models.
We reserve the right to remove or disable access to any content that violates these Terms or that we deem inappropriate, at our sole discretion and without prior notice.
Your Content is your responsibility
You are solely responsible for Your Content and for the consequences of publishing it. You publish it under your own responsibility, in your own name, and at your own risk. We do not endorse, verify, adopt or take responsibility for any member content, and no member content represents our opinion.
Our own material
The Service itself, including its software, design, layout, text, logos and marks, belongs to us or our licensors and is protected by intellectual property law. These Terms grant you no licence to it beyond using the Service as intended.
6. Our Role as a Host
We provide hosting for content supplied by members. We do not create, select, review or edit member content before it is published, and we have no general obligation to monitor the content we host or to actively seek facts indicating illegal activity.
This reflects our status as a hosting provider under applicable law, including Article 6 of Regulation (EU) 2022/2065 (the Digital Services Act) and the corresponding provisions of national law. We are not liable for member content of which we have no actual knowledge, and upon obtaining actual knowledge or awareness of illegal content we act expeditiously to remove it or disable access to it.
Any review, moderation or filtering we do carry out is voluntary. Carrying it out does not make us the author or publisher of member content, does not create an obligation to carry it out in any other case, and does not deprive us of the protections available to hosting providers.
7. Illegal Content: Notice and Action
Any individual or entity may notify us of content on the Service that they consider to be illegal. Send notices through our Discord server or to the contact address published on our contact page.
To allow us to act, a notice should contain:
- A sufficiently substantiated explanation of why the content is illegal
- The exact electronic location of the content, in particular the exact URL or URLs
- Your name and email address, except where the content concerns child sexual abuse material or certain other offences
- A statement that you believe in good faith that the information in the notice is accurate and complete
We will confirm receipt of a notice without undue delay where contact details were provided, decide on it in a timely, diligent, non-arbitrary and objective manner, and inform you of our decision. Where we restrict content or an account, we will provide a statement of reasons to the affected member unless the law prevents us from doing so.
Complaints against our decisions
If you are affected by a decision to remove content, restrict visibility, suspend or terminate an account, or suspend the handling of your notices, you may lodge a complaint with us for a period of six months from that decision, using the same contact channels. We will review complaints in a timely, non-discriminatory, diligent and non-arbitrary manner, and reverse the decision where the complaint shows it was wrong.
Misuse
We may suspend, after a warning and for a reasonable period, the handling of notices and complaints from persons who frequently submit notices or complaints that are manifestly unfounded, and the provision of the Service to members who frequently provide manifestly illegal content.
8. Copyright and Intellectual Property Complaints
We respect intellectual property rights and expect members to do the same. If you believe content on the Service infringes a right you own or control, send us a notice containing:
- Identification of the protected work or right you claim has been infringed
- Identification of the material claimed to be infringing, with the exact URL
- Your contact details, including an email address
- A statement that you have a good-faith belief that the use is not authorised by the rights holder, its agent, or the law
- A statement that the information in the notice is accurate, and that you are the rights holder or authorised to act on their behalf
- Your physical or electronic signature
We will remove or disable access to material that is the subject of a valid notice. The member who posted it may submit a counter-notice stating, under penalty of perjury where applicable, that the material was removed as a result of mistake or misidentification. We may restore the material if we do not receive notice of legal proceedings within a reasonable period.
We operate a repeat-infringer policy: accounts that are the subject of repeated valid infringement notices will be terminated.
Warning. Knowingly submitting a false or bad-faith infringement notice may make you liable for damages, including costs and legal fees.
9. Community Guidelines and Moderation
isafemboy.gay is a community-driven platform. We expect all members to treat each other with respect and kindness. Our moderation team actively monitors the platform to maintain a safe and welcoming environment.
Moderators have the authority to:
- Issue warnings for minor violations
- Temporarily suspend accounts for repeated or serious violations
- Permanently ban users who engage in severe misconduct or repeated violations
- Remove content that violates these Terms or community standards
All moderation decisions are made at our sole discretion. We reserve the right to take any action we deem necessary to protect the integrity and safety of the community.
Moderation is carried out by volunteers using the information available to them. We do not guarantee that every violation will be detected, that any report will produce a particular outcome, or that moderation will occur within any particular time. Absence of moderation action is not approval of the content in question.
10. Invitation System
Access to the Service is granted through an invite-only system. Each member may receive a limited number of invitation codes to share with others. By distributing invitation codes, you vouch for the recipients and assume responsibility for ensuring they understand and will comply with these Terms.
Invitation codes are non-transferable and may not be sold, traded, or exchanged for compensation. Violation of this policy may result in immediate termination of your account and forfeiture of invitation privileges for all parties involved.
Invitation codes carry no monetary value, confer no rights, may expire, and may be revoked at any time before they are redeemed. We may reduce, withdraw or refuse to issue invitations at our discretion.
11. Subdomain Assignment and Usage
Upon account creation, you will be assigned a unique subdomain (e.g., yourname.isafemboy.gay). Subdomains are subject to availability and must comply with our naming policies. We reserve the right to reclaim or reassign subdomains that:
- Violate trademark or intellectual property rights
- Impersonate individuals, organizations, or brands
- Contain offensive, inappropriate, or misleading content
- Remain inactive for an extended period (typically 90 days or more)
Subdomain changes may be requested but are not guaranteed. We will make reasonable efforts to accommodate legitimate requests.
A subdomain is licensed to you for use while your account is active. You acquire no ownership, no goodwill and no property right in it, and no right to transfer or sell it. Squatting, bulk registration and reservation for resale are prohibited.
12. Third-Party Services and Links
The Service depends on third parties, including Discord for authentication and identity, and our hosting and infrastructure providers. Their availability, terms and policies are outside our control. If a third party changes, restricts or terminates its service, features of the Service may stop working, and we are not liable for that.
Member pages may contain links to, and embedded content from, external websites and platforms. We do not control, review or endorse those destinations, we are not responsible for their content, their availability, or their handling of your data, and following them is at your own risk. Their own terms and privacy policies apply once you leave the Service.
13. Service Availability and Modifications
We strive to provide reliable and uninterrupted service, but we do not guarantee that the Service will always be available, error-free, or free from interruptions. We may modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, for maintenance, updates, or other reasons.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
There is no service level agreement, no guaranteed uptime, and no guaranteed support response time. The Service may be provided in a beta or experimental state, and features may change or be withdrawn.
Back up your own content. We keep backups for our own operational purposes, but we do not guarantee that data can be recovered. You are responsible for keeping your own copies of anything you would not want to lose.
14. Termination
We reserve the right to suspend or terminate your account and access to the Service at any time, for any reason, including but not limited to:
- Violation of these Terms or our community guidelines
- Fraudulent, abusive, or illegal activity
- Extended period of inactivity
- At our sole discretion without cause
Upon termination, your right to use the Service will immediately cease. We may delete your account and all associated content without liability. Termination does not relieve you of any obligations incurred prior to termination.
You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon voluntary termination, we will make reasonable efforts to delete your data in accordance with our Privacy Policy.
The sections on content licensing for retained copies, disclaimers, limitation of liability, indemnification, governing law and miscellaneous survive termination.
15. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- The Service will meet your requirements or expectations
- The Service will be uninterrupted, timely, secure, or error-free
- The results obtained from using the Service will be accurate or reliable
- Any errors in the Service will be corrected
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ISAFEMBOY.GAY, ITS OPERATORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Unauthorized access, use, or alteration of your content
- Any other matter relating to the Service
Scope of our liability
The Service is provided free of charge. Subject to the mandatory exceptions below, we are liable only for damage caused intentionally or by gross negligence.
For slight negligence, we are liable only where we breach an obligation whose fulfilment is essential to the proper performance of this agreement and on whose observance you may regularly rely (a cardinal obligation). In that case our liability is limited to the foreseeable damage typical for this kind of agreement. Liability for slight negligence is otherwise excluded, in particular for loss of data, loss of profit, loss of reputation, and indirect or consequential damage.
What is never excluded
Nothing in these Terms excludes or limits our liability for injury to life, body or health; for damage caused intentionally or by gross negligence; under mandatory product liability law; where we have fraudulently concealed a defect or given a guarantee; or for any other liability that cannot lawfully be excluded or limited. Where mandatory consumer protection law of your country of residence gives you rights that these Terms would otherwise restrict, those rights are unaffected.
Content and conduct of others
We are not responsible for the content, accuracy, legality or safety of anything published by members, for the conduct of any member or visitor, whether online or offline, or for any interaction, transaction or dispute between you and another person arising from the Service. You use member pages and interact with other members at your own risk.
Data loss
To the extent permitted by law, we are not liable for the loss, corruption or deletion of data. Where we are liable for data loss, our liability is limited to the cost of recovering the data from a backup you were required to keep in any event.
These limitations apply to our operators, administrators, moderators, volunteers, contractors and affiliates on the same terms as they apply to us.
16. Indemnification
You agree to indemnify, defend, and hold harmless isafemboy.gay, its operators, employees, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:
- Your use of and access to the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
- Any content you post or share through the Service
This obligation applies only to the extent that the claim is attributable to your conduct or Your Content, and not to the extent that it results from our own intentional or grossly negligent act. We will notify you of any such claim, will not settle it without consulting you, and you may participate in its defence at your own expense.
17. Force Majeure
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of nature, fire, flood, epidemic, war, civil unrest, government action, labour disputes, failures of power, internet or telecommunications infrastructure, denial-of-service or other attacks, or the failure, suspension or discontinuation of a third-party service on which the Service depends.
18. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service operators are based, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall be resolved through good faith negotiations. If negotiations fail, disputes may be resolved through binding arbitration or in the courts of competent jurisdiction, as determined by the nature and severity of the dispute.
If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country in which you are habitually resident, and you may also bring proceedings in the courts of that country.
The European Commission provides a platform for online dispute resolution, available at ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
Before starting formal proceedings, please contact us so we can try to resolve the matter directly. Most issues can be settled quickly this way.
19. Miscellaneous
Entire Agreement: These Terms constitute the entire agreement between you and isafemboy.gay regarding the use of the Service and supersede all prior agreements and understandings.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision is replaced by a valid one that comes closest to its commercial purpose.
Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign or transfer these Terms without restriction.
No partnership: Nothing in these Terms creates a partnership, joint venture, agency or employment relationship between you and us.
Language: These Terms are provided in English. Where we supply a translation, the English version prevails in the event of a conflict.
Notices: We may give you notice by posting on the Service, by message on our Discord server, or by email to the address associated with your account.
20. Contact Information
